Sometimes We Need That Little Reminder...

As many of you know I have represented more than 700 cases before OSHA over the past 18 years - everything from minor other-than-serious violations up to willful ones.

Over the years I’ve had clients who worked very hard to improve workplace safety, but when it comes to OSHA visits, they keep getting cited.

One of the main reasons this continues is because they can’t bring themselves to comply with one of OSHA’s 4 requirements for preventing OSHA citations, so when an employee is caught violating an OSHA standard they get cited.

Here are the 4 OSHA requirements. Can you pick which one everyone seems to struggle with?

  1. Establish Policies and Procedures that Meet OSHA Requirements
  2. Effectively Communicate Your Safety Program and Procedures to Your Employees
  3. Perform Regular and Frequent Worksite Inspections
  4. Enforce Your Safety Policies and Procedures

Well, which one did you pick?

If you picked number 4 “Enforce Your Safety Policies and Procedures”, you were correct.

Enforcing workplace safety seems to be one of the most difficult requirements for any employer.

Although I believe that it is one of the best ways to reduce accidents in the workplace, many of the employers I’ve represented over the years have told me safety is just common sense so they don’t see the value.

Usually that’s when I explain that I agree that workplace safety is basically common sense, but sometimes we need that little reminder to use it.

So this brings me to an example of enforcement that I experienced firsthand last week while driving down to Hollywood, Florida to visit my daughter.

To get from Ohio to Florida you eventually have to get on I-95.As we were driving through Georgia on I-95, the speed limit was 70 MPH and everyone was rolling along around 65-75 MPH – well within the acceptable speed limit.I would say that about every 5 miles or so you would see highway patrol in the median or they would have someone pulled off to the side issuing a ticket.

Once we hit Florida, that all changed.Although the speed limit was still 70 MPH, to keep with the flow of traffic we went from 75 to 80.At one point, to stay with the flow of traffic, everyone was up to around 92 MPH.I’m not exactly sure if everyone thought that I-95 meant the speed limit was 95, but I can tell you that even at 92 there were cars passing on the left.

The difference between Georgia and Florida was just 1 thing.There wasn’t a highway patrol in sight in Florida – No Enforcement.

You would think that common sense would tell you that 65-75 MPH is a safer speed to travel than 92 MPH, but apparently getting to our destination just a little quicker overrides common sense . . . unless there are a few Highway Patrol to remind us.

Workplace safety is no different.Sometimes we need that little reminder and enforcement does just that.
