They Think Their Program Should Only Include...

Today I’d like to take a look at a blast from the past, the April 15, 2013 Safety E-QuickTip.It was called “The Hazard was Created by Another Company.”

This involves an issue we continually find ourselves discussing with employers every day.

So here goes.

This week I was talking with a potential client about our online safety programs and a question came up that I've been hearing more and more. "If we purchase a safety program from your company, can we modify it to meet the specific hazards of our industry or trade?"

When I'm asked that question, it is usually for one of the two following reasons: 1. The caller is the safety director for the company and he wants to use our program as a template that he can tweak to make their own; or 2. It's because they think their program should only include hazards specific to the work they are performing.

Today I want to talk about the second reason.

As you may recall at US Compliance Systems, we represent employers that have been cited by OSHA. While reviewing violations with our clients we often find that many of the citations issued to companies we are representing are issued because of a hazard that their employees were exposed to that was created by another employer and NOT because of a hazard created from the work they were performing.

That's right - the hazard was created by another company.

The hazard may have been created by another contractor working on the same jobsite, a contractor working in a facility or even a hazard created by a facility where an outside contractor was working.

It doesn't matter who creates the hazard in the workplace.If your employees are exposed to that hazard you are responsible for protecting them from the hazard.

If you take some time and go to OSHA's website and look up the employer’s responsibilities, you will see that OSHA says an employer must provide a workplace free from recognized hazards. What you won't find is that an employer must provide a workplace free of only the recognized hazards created by the work their company is performing.

So, if you are someone responsible for putting together and maintaining your company's safety program, make sure your program also includes protection of your employees from hazards created by other companies working beside you.

And remember, if you have 11 or more employees, don’t forget to post last year’s completed OSHA 300A starting this month (February) through April 30.
